Terms of Service

1. Acceptance of Terms

By accessing or using UNDER THE HOOD ("the Service," "we," "us," or "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service. We may update these Terms from time to time; continued use of the Service after changes constitutes acceptance.

2. Description of Service

UNDER THE HOOD is a digital subscription product providing DIY automotive repair guides, an AI mechanic advisor ("Rex"), an estimate decoder, vehicle management tools, and related educational content. All content is provided for general informational and educational purposes only.

3. Subscription Tiers and Payments

Access is offered in three tiers: Free, Garage Pro (recurring subscription), and Lifetime (one-time payment). Subscriptions and one-time purchases are processed by our authorized billing partner, Whop, Inc. ("Whop"). By purchasing, you also agree to Whop's terms of service and payment processor terms.

Garage Pro subscriptions renew automatically until canceled. You may cancel at any time from your Whop account. Cancellation takes effect at the end of the current billing period; no partial refunds are issued for unused time. Lifetime purchases are non-refundable except where required by law.

4. Refund Policy

Garage Pro: cancel anytime, retain access until end of billing cycle. No partial refunds.

Lifetime: refundable within 14 days of purchase if you have NOT used Rex AI more than 5 times AND have not consumed the Estimate Decoder. Beyond 14 days, all sales are final.

Refunds are processed through Whop. Contact us at the email provided in the footer to initiate.

5. User Conduct

You agree not to: (a) share your account or membership credentials; (b) scrape, copy, or republish guide content; (c) use the AI advisor or estimate decoder to facilitate illegal activity, harassment, or harm; (d) attempt to reverse-engineer, exploit, or attack the Service; (e) submit false vehicle information to gain unauthorized access; (f) resell access to the Service. Violations may result in immediate account termination without refund.

6. Intellectual Property

All guide content, code, design, AI prompts, logos, and other materials are the property of UNDER THE HOOD and its licensors and are protected by copyright, trademark, and other laws. Your subscription grants a limited, non-exclusive, non-transferable license to access the Service for personal, non-commercial use only.

7. Safety, Disclaimer, and Liability

Automotive work is inherently dangerous. The Service provides educational information only, and is not a substitute for professional automotive diagnosis, certified mechanical service, or vehicle manufacturer guidance. AI-generated responses (Rex, the estimate decoder) may contain errors or out-of-date information.

By using the Service you agree that all repair, maintenance, diagnostic, and modification activities you perform on any vehicle are undertaken entirely at your own risk. The Service is provided "as is" and "as available" without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, accuracy, or non-infringement.

To the maximum extent permitted by law, UNDER THE HOOD, its operators, contributors, and affiliates shall not be liable for any direct, indirect, incidental, special, consequential, exemplary, or punitive damages — including personal injury, death, property damage, vehicle damage, voided warranties, failed inspections, accidents, fires, or any other loss — arising out of or connected with your use of the Service or reliance on any content, AI output, or third-party link contained therein, even if we have been advised of the possibility of such damages.

Safety-critical systems (brakes, fuel systems, airbags, suspension, steering, hybrid/EV high-voltage) can cause serious injury or death if repaired improperly. If you are not fully confident in your ability to perform a repair safely, stop and consult a licensed professional mechanic. Never work on a vehicle supported only by a hydraulic jack — always use jack stands.

8. Indemnification

You agree to indemnify, defend, and hold harmless UNDER THE HOOD and its operators from any claims, demands, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) your use of the Service; (b) any repair, modification, or maintenance you perform on any vehicle whether or not based on Service content; (c) any injury to persons or damage to property resulting therefrom; (d) your violation of any applicable law or third-party right; (e) your violation of these Terms.

9. Third-Party Services and Links

The Service relies on third-party providers including Whop (payments), Anthropic / Claude (AI), MongoDB Atlas (data storage), and hosting providers. We are not responsible for the privacy practices, terms, or availability of these third parties. Links to retailers (Amazon, RockAuto, etc.) for parts and tools are informational and may include affiliate codes.

10. AI-Generated Content

The "Rex" AI advisor and estimate decoder are powered by third-party language models. Responses may contain errors, omissions, hallucinations, or out-of-date information. Treat AI output as a starting point for your own research, not as professional mechanical advice. We log AI queries and responses for safety review, abuse prevention, and product improvement. For high-risk repairs (brakes, fuel, suspension, airbags), the AI is configured to recommend professional service rather than provide DIY instructions.

11. Account Termination

We may suspend or terminate your account at any time for violation of these Terms, fraudulent activity, abuse of AI rate limits, chargebacks, or other harmful conduct. You may close your account at any time by canceling your subscription at Whop. Upon termination, your access to paid content ends immediately; your saved data may be retained per our Privacy Policy.

12. Governing Law and Disputes

These Terms are governed by the laws of the United States and the state in which UNDER THE HOOD is operated, without regard to conflict-of-laws principles. Any dispute arising out of or relating to these Terms or the Service shall be resolved through binding individual arbitration, except that either party may seek injunctive relief in court for intellectual property infringement. You waive any right to participate in class-action litigation.

13. Severability and Entire Agreement

If any provision of these Terms is held unenforceable, the remaining provisions remain in full force. These Terms, together with the Privacy Policy, constitute the entire agreement between you and UNDER THE HOOD regarding the Service.
